01 Acceptance of Terms

By accessing or using Mindset (the "Service"), operated by Peakdyne Systems Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service and Privacy Policy (collectively, the "Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Peakdyne Systems Inc. You must be at least 13 years of age to use the Service. Use of the Service by minors between the ages of 13 and 18 is subject to the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on their behalf.

02 The Game — How It Works

Mindset is a real-time, two-player word association game. The core mechanics are proprietary to Peakdyne Systems Inc. and are protected by applicable intellectual property law. The gameplay involves:

• Convergent word guessing: Two players are presented with the same pair of seed words and independently submit a single word they believe best relates to or bridges both seed words. The goal is for both players to independently arrive at the same word.
• Iterative rounds: If both players' guesses do not match, those guesses become the new seed words for the next round. Play continues until both players submit an identical word simultaneously, achieving "Mindset."
• Real-time synchronization: The game state is synchronized between players in real time. Neither player can see the other's guess until both have submitted in a given round.
• Game sharing: Players may invite others via a unique five-character game code or a direct share link.
• Random matchmaking: Players may opt to be matched with a random anonymous opponent.
• Device-based identity: Players are identified by a unique device identifier stored locally. An optional email backup and cross-device sync feature is available.

03 Intellectual Property

All content, design, source code, game mechanics, trade dress, branding, and materials comprising the Service are the exclusive property of Peakdyne Systems Inc. and are protected under Canadian and international copyright, trademark, and trade secret laws. Mindset has been in continuous operation since 2026, establishing prior use of its name, design, and game mechanics.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your personal, non-commercial enjoyment. This licence does not include the right to:

• Copy, reproduce, distribute, or publicly display any part of the Service;
• Modify, adapt, translate, or create derivative works based on the Service or its underlying mechanics;
• Reverse engineer, decompile, or disassemble any software component of the Service;
• Use any data mining, scraping, or similar automated data extraction methods on the Service;
• Replicate, clone, or commercially exploit the game mechanics, design, or concept of Mindset in any product or service without prior written consent from Peakdyne Systems Inc.

Any unauthorized use terminates the licence granted herein and may result in legal action. Peakdyne Systems Inc. actively asserts and defends its intellectual property rights.

04 User Conduct & Content

Mindset is a word game. While gameplay is limited to single-word submissions, those words constitute user-generated content. By using the Service, you agree that you will not submit words or use the Service in any manner that is:

• Hateful, discriminatory, or abusive based on race, ethnicity, gender, religion, sexual orientation, disability, or any other protected characteristic;
• Sexually explicit, obscene, or otherwise inappropriate;
• Threatening, harassing, or intimidating toward any person;
• In violation of any applicable law or regulation;
• Intended to deceive, defraud, or harm other users.

By using the Service, you acknowledge that you may encounter words or gameplay that you find offensive. You assume full responsibility for your interactions with other users. Peakdyne Systems Inc. is not liable for any content submitted by users.

05 Disclaimer of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEAKDYNE SYSTEMS INC. SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of data, profits, goodwill, or other intangible losses;
• Damages resulting from user-generated content, interactions between users, or conduct of third parties;
• Damages arising from unauthorized access to or alteration of your data;
• Service interruptions, outages, or errors.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law. Your sole remedy for dissatisfaction with the Service is to stop using it.

06 Privacy, Data & PIPEDA

Data we collect:

• Anonymous account: A randomly generated identifier created when you first open Mindset and remembered on your device. It identifies your account and associates your games. It is not tied to your name, email, or any personally identifiable information unless you voluntarily provide an email address.
• IP address: Collected transiently for abuse prevention and rate limiting. Not stored long-term or sold.
• Game data: Words submitted during gameplay, game history, and game state are stored on our servers to enable real-time multiplayer functionality.
• Email address (optional): If you choose to use the backup and sync feature, your email address is stored and used solely for verification and cross-device account linking. We do not send marketing email.
• Alias: The display name you choose (or that is auto-generated) is stored and visible to players you play with.
• Notification address (optional): If you turn notifications on, a push address for your device (a browser push subscription, or a Firebase Cloud Messaging token in the Android app) so we can tell you when it is your turn. Notifications never contain anyone's guess.
• Error reports: Short technical reports when something goes wrong in the app (error message, app state, your anonymous identifier, browser or device type), used only to fix problems.
• Usage analytics: Google Analytics measures how the Service is used (pages and screens visited, device and browser type, approximate location derived from IP address). Used in aggregate to improve the Service, not for advertising.

Data we do not collect: We do not collect your real name, precise location, payment information, or any sensitive personal data. Mindset does not show ads, does not use advertising trackers, and does not sell data to third parties.

Data retention: Game data is retained for operational purposes; the Privacy Policy sets out how long each kind of data is kept. You may request deletion of your data at any time by contacting us at [email protected]. The identifier stored on your device can be cleared by clearing your browser or app data.

Cookies: Mindset itself uses browser local storage, not cookies, to remember your session. Google Analytics sets its own cookies to measure usage.

Third-party data processors: Your data may be processed by our infrastructure providers — database and real-time infrastructure (Supabase), hosting, network and security (Cloudflare), usage analytics (Google Analytics), notification delivery (the push services of Google, Apple, Mozilla and Microsoft) and transactional email — solely for the purpose of delivering the Service. We do not sell your data to third parties for commercial purposes. These providers are bound by their own privacy policies and data processing agreements.

PIPEDA: Peakdyne Systems Inc. complies with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Canadian privacy law. You have the right to access, correct, or request deletion of your personal information by contacting us at [email protected].

Children: The Service is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us immediately at [email protected] and we will promptly delete it.

07 Accounts & Device Identity

Your Mindset "account" is tied to a device identifier generated and stored in your browser. There is no traditional username/password login. If you clear your browser data, you will lose access to your existing games unless you have set up email backup and sync.

You are responsible for any activity that occurs under your device identifier. Peakdyne Systems Inc. is not responsible for any loss resulting from your failure to maintain access to your device or browser data.

08 Termination

Peakdyne Systems Inc. reserves the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. You may stop using the Service at any time.

09 Changes to These Terms

We may modify these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We will update the effective date at the top of this document when changes are made. We encourage you to review these Terms periodically.

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.
